Richard’s role is to advise anyone of the potential classes of interested parties where a business, or individual, is facing either a stressed or distressed, financial position.
His principal clients are insolvency practitioners; secured and unsecured creditors and litigation funders. He has acted for charity trustees, sole traders and company directors.
Richard specialises in contentious cases on behalf of insolvency practitioners, often where there are allegations of fraud, where the aim is to identify, preserve and recover assets on behalf of creditors.
Work highlights include:
- Advising the administrators and administrative receivers of various companies within the Cammell Laird Group of companies.
- Acting for the trustee in bankruptcy in what is still the leading case on the public sector equality duty considering a finding that HMRC’s treatment of a disabled woman was discriminatory.
- Working with a former professional footballer in defending a claim made by his trustee in bankruptcy against his PFA pension.
