Damian regularly acts on behalf of insolvency professionals, private individuals and companies.
Work highlights include:
- Successfully advising on a complex fraud claim concerning a company that operated in the renewable energy market. This resulted in a six-figure payment to our client following a series of mediation.
- Acting on behalf of joint liquidators (of a company trading as an unregulated forex trader suspected of operating a Ponzi scheme with unsecured creditors in excess of £60m) in obtaining freezing injunctions and pursuing multi-million pound misfeasance claims against its former directors.
- Acting for a claimant in respect of a dispute concerning the beneficial ownership of a number of significant investment and agricultural investment properties. The matter also involved a series of complex interconnected corporate insolvencies.
- Acted for former wife of a bankrupt facing claims from the Trustee in Bankruptcy and secured lender in respect of the beneficial interest a number of properties. The matter involved complex legal arguments surrounding allegations of fraud and dishonesty. Further issues included arguments as to the equity of exoneration and the principles considered in the Court of Appeal case in Armstrong v Onyearu [2017] EMWA Civ 268.
