Charity Law and Governance

Having extensive experience in corporate and charity law issues we appreciate the complexities of the regulatory regimes under which schools have to operate.

All academies are charities regulated by the Department for Education and subject to the Charities Acts, in addition they are limited companies subject to the Companies Acts. Many independent schools are charitable companies or charitable foundations and some maintained schools operate as charitable foundations.

Our experience means that we are well placed to advise our school clients of their rights and responsibilities and the duties of their governors and officers placed upon them.

Work we undertake includes: 

  • Advising on the structure of governing bodies and their responsibilities and powers
  • Providing seminars and workshops for governor and officer training
  • Advising on the extent and limitation of charitable powers and objects and how additional activities can be accommodated through corporate group structures
