Brexit and Employment Law

A White Paper entitled, “The Future Relationship between the United Kingdom and the European Union” was published yesterday by the Government. This White Paper can be found here. 

The key paragraph being paragraph 123 states “…the UK proposes that the UK and the EU commit to the non-regression of labour standards. The UK and the EU should also commit to uphold their obligations deriving from their International Labour Organisation commitments.”

As a result, none of the EU based laws will be repealed. This means that legislation such as TUPE, the Working Time Regulations, collective consultation requirements and the majority of discrimination legislation will not be amended once we leave the EU.
