Oil in a Day’s Work

Schofield Sweeney’s litigation team has been acting for a national association of lubricant blenders and manufacturers which operates a body dealing with the verification of lubricant specifications in the UK. 

A former member of the Association, which had been the subject of a complaint which was resolved through the Association, has recently joined a European based association and posted a notice on its website announcing that it had become a member of the European lubricant standards body.  Unfortunately, within the post, the company denigrated the UK Association’s verification service describing it as “not independent” or “credible” and suggesting it was organised for the benefit of UK blenders “with their own agendas”. 

The UK association took exception to the post; the European based association is similarly organised by leading industry players and also took exception to the suggestion that it was not independent or credible and the implication that instead of seeking to protect consumers and end users, the association was being used to protect industry members. 

Schofield Sweeney’s litigation team wrote to the lubricant blender concerned asserting that the statement was both defamatory and a malicious falsehood and requiring it to be amended/withdrawn.  The former member acted upon the demand and amended the posting on its website to take out the offending material.
